Forest Holidays LLP
(referred to as Forest Holidays/we/our/us) makes sales of camping
& caravanning holidays via www.forestholidays.co.uk (the
“Website”), , via its call centre, via email requests, via postal
requests and takes bookings direct at the camping & caravanning
sites. Any person wishing to book a holiday via any of these
methods (referred to as “you/your”) acknowledges that such booking
is made subject to our terms and conditions set out below.
You may only request a
booking if you agree to these terms and conditions. By
requesting a booking you are deemed to have accepted these terms
and conditions as governing your booking. This does not
affect your statutory rights as a consumer.
We reserve the right to
change these terms and conditions at any time. Any such
changes will take effect immediately when posted on the Website, in
the brochure, at the campsites, or otherwise brought to your
attention. It is your responsibility to read the terms and
conditions each time you request a booking and any such request
shall signify you have accepted to be bound by the latest set of
terms and conditions. A copy of the terms and
conditions are available upon request
1. Booking
Confirmation
When you wish to place a booking for a
holiday (“Booking Request”) with us, you will complete a booking
form (either on the Website, over the phone, by email, or at the
camping and caravanning site). It is your responsibility to
provide us with the correct information. If you have made the
Booking Request via the telephone, we will read back your details
to you. You will be responsible for the booking regardless of
any input errors.
For all Booking Requests we
process, we shall issue written confirmation accepting your Booking
Request with a booking reference number. Once Forest Holidays
has issued such written confirmation it shall have entered into a
contract with you.
Bookings made in advance are
subject to minimum stays, These vary by site and by season: please
refer to the pricing grid for more details. Subject to
availability, one night bookings can be taken during any season
when made directly on arrival on site and not booked in
advance.
By making a Booking Request
you warrant that you have the authority of all persons in your
party to book on their behalf, accept these terms and conditions
and that you will indemnify Forest Holidays and keep Forest
Holidays fully and effectively indemnified against all loss and
damage arising directly or indirectly, from any act or default by
yourself or any person or animal accompanying you.
Bookings are not
transferable to anyone other than the lead name of the booking.
In addition to these terms
and conditions, there may be specific rules and regulations which
apply to individual sites.
You must be over 18 years
old to make a booking and to stay on a pitch with no other
adults.
2. Services,
Features and Facilities
These will, where applicable,
be prominently displayed in the reception area of each
site. Features, facilities or services referred to in the
brochure or the Website (e.g. bike hire, pony trekking and boat
hire) may be supplied by third parties and Forest
Holidays shall not have any responsibility for loss, damage or
injury in relation to these features, facilities and services which
we do not provide.
Information about features,
facilities and services at your holiday, is, to the best of our
knowledge and belief, accurate at the time of publication of the
brochure and Website, but some of these features, facilities and
services may not be available at the time you take your
holiday.
As our sites are located in
a forest environment, we cannot accept responsibility for any
damage, injury or inconvenience caused by plants or
wildlife.
3. Pitches and Units
Unit
A tent, trailer tent,
caravan or motorhome up to maximum of 8 x 6 metres, inclusive of
guy ropes. (A motorhome may tow a car with an
A-Frame).
XL unit
A unit which exceeds 6m
x 8m. These units are subject to a supplement of £3.00
per night. If the supplement is not paid at the time of booking,
our site managers have the right to request this additional fee on
site. This supplement comes into effect on the 1st January
2010.
Standard or
Two-Person Pitch
An undefined pitch
to station your Unit on and includes the first two people within
the price (1 person must be over 18 years of age). This does
not include electric hook-up or hardstanding. Space for
one attached single awning or one toilet tent or a small trailer is
also included in the two-person pitch price. One car (or
motorbike) may accompany all units on pitch. Additional
cars (or motorbikes) will be charged for but may not be
situated directly on the pitch.
Premium
Pitch
As per
a Standard Pitch and includes electric hook-up and/or
hardstanding. Additional £5.00 per pitch, per night over a
standard pitch price
Select
pitch
As per a Premium Pitch and
includes a picnic table and a larger pitch. Additional
£7.50 per pitch, per night over a standard pitch price
Select Plus
pitch
Available at selected sites.
As per select pitch but also includes water and waste
drainage and TV point. Additional £10.50 per pitch per
night over a standard pitch price.
Additional
People
Pitch prices are for two
people. Extra adults and children can be purchased for up to
a maximum of six people on one pitch. An extra child is a
person aged between 5 and 16 years old). Children under 5
years old go free. For parties larger than 6 people,
multiple pitches must be booked. Group bookings of over six
units are accepted at the discretion of Forest Holidays, please
call for details.
Visitors
Forest Holidays is happy to accommodate upto four visitors per
pitch per day at a cost of £2 per visitor and £3 per car. It is
essential, for secutity, that visitors report to the Site Manager
immediately on arrival. Entry to the site and parking on site will
be at the Site Managers discretion. Visitors are required to leave
the site by 10:30pm or when the site varriers are closed for the
night, whichever is the earlier.
Extras
Pitch Extras include: Pup tents,
gazeebos (no more than 3 x 3 m) double awnings, (larger than the
width or length of your caravan) large trailers (over
1.2m) additional car. Forest Holidays allows you to book one
extra per pitch at a cost of £5.00 per night. Pup tents are free of
charge and must be a meximum size of 2 x 1.5m, be used by upto two
under 16's and erected in the boundary of the pitch of
the accompanying unit. Extras must be paid for at the
time of booking, especially at Bank Holidays, as we cannot
guarantee that there will be space. Site managers reserve the right
to ask you to remove any windbreaks or gazebos. Individual site
rules may apply.
Forest Holidays Card
The Forest Holidays
Card cost £15 per year and entitles the bearer to forego the Non
CCC or FHC holder fee and not incur the charge of a booking
amendment fee if changes are made upto three days before the start
of the holiday. Full payment for the card is required at time of
purchase and is non refundable.
4. Prohibited
activities
To protect our forests, the burning of wood is strictly prohibited.
Charcoal only BBQ's are allowed, providing they are raised
off the ground. No open fires or fire pits are permitted.
Rope swings are also prohibited.
5.
Management
Empowerment for all aspects of site operational management lies
with the Site Managers. Forest Holidays fully supports
its Site Managers in dealing with matters of policy at their sole
discretion when the need arises. In placing a Booking Request
you agree that you and your party will at all times comply with
requests of the site managers.
To respect the enjoyment of
others, we ask that noise levels are kept to a minimum after
10:30pm
6.
Payment
All sites accept credit and debit cards with
the exception of American Express cards. All one night stays
are subject to a £2 administration charge. For holidays of
three nights or less, the full cost is payable at the time of
booking. For holidays of four nights or more, a
non-refundable deposit of £30 per pitch is payable on all advance
bookings.
The balance is payable when
you arrive on site. To facilitate a quicker check in on site,
particularly during weekends and peak periods, it is recommended
that full payment is made in advance. Please note that full
payment will be required at the time of booking if the period of
your stay encompasses a Bank Holiday Weekend.
Cheques can only be accepted
at least 15 days prior to the start of your holiday. Cheques are
not accepted on site. A 2% surcharge is added to payments
made by credit or charge card.
The price of your pitch
entitles you to locate:
a) one car/motorcycle and one tent/caravan/trailer tent, sized at
no more than 8 x 6 meters, or
b) one motorhome, sized at no more than 8 meters, and one
car/motorcycle
within the boundaries of the
Forest Holidays campsite for the period stated on your
confirmation. Space for one attached single awning or one
toilet tent or a small trailer
is included in the pitch price.
Children pay children’s fees
at sites from their 5th birthday and before their 16th
birthday.
7.
Cancellation
If you cancel your holiday up to three days before, you will
forfeit the first £30 per pitch, or the amount paid at the time of
booking if less than £30. If you cancel within three days,
you will forfeit all money paid and owing on your holiday,
including the cost of any Forest Holidays Card purchased.
Our customers visit our
sites to enjoy the peace and tranquility of the forest. If
anyone does not respect this, the Site Manager reserves the right
to refuse them admission or ask them to leave the site at any time.
If you are asked to leave under these circumstances, no
monies will be refunded.
In the unlikely event that
Forest Holidays has to cancel or change your holiday, we will offer
you the choice of a full refund of all monies paid to us or the
option of re booking your holiday at a comparable standard (with
you paying any additional cost or receiving a refund in respect to
the price difference). No compensation is available.
8.
Amendments
If you want to amend your booking you must
notify Forest Holidays as soon as possible. Amendments to
your booking can be made up to 3 days prior to the start date of
your holiday and are subject to availability and to a £12
administration fee. Should you wish to transfer your booking
to another location and/or date, we will use our reasonable
endeavours to satisfy your request wherever possible, but shall be
under no obligation to do so. Any administration fee will be
waived for Forest Holidays Card holders and Camping &
Caravanning Club Members.
9.
Pricing
The prices are based on a daily rate
unless otherwise stated. Prices include VAT at the current
prevailing rate where applicable. Whilst we will make every
effort to ensure that our prices remain unchanged, they may be
amended at any time prior to payment of the final balance. In
such circumstances, you may cancel your booking by giving notice in
writing, by Recorded Delivery, within 14 days of the issue date
printed on your invoice, and we will refund all monies paid in
respect of the booking. Please note the prices advertised in
our brochure and on our website are applicable up to and including
11th January 2011 only.
10.
Dogs
Well-trained dogs are welcome on sites that
accept dogs, subject to payment of the appropriate supplement (£1
per dog per night up to a maximum of 3 dogs per pitch). They
must be kept under proper control and must be kept on a lead at all
times. All traces of their presence must be removed before you
leave and any fouling must be collected and disposed of.
11.
Groups
Single sex groups and large groups are welcome
at the Site Manager’s discretion. Please make us aware
at the time of booking if you are an all male or all female group
or a group of 6 units or more. It is essential that you
and your party will at all times comply with any policies or rules
specific to the site or any reasonable instructions or requests of
the Site Managers
12. Arrival and
Departure
It is important that customers report to the Site Manager on
arrival, before pitching and to pay the fees in advance.
Arrival times on-site are
between midday and dusk. However, should you wish to arrive
earlier, please ring the Site Manager on the morning of your
arrival and they will do their best to accommodate your request.
There will be a charge of £3.00 for arrivals before
12.00pm. If you are likely to arrive late, please let
the Site Manager know. Subject to availability, we accept bookings
on all our sites up to 10pm on your day of arrival.
For advance bookings, if not
notified otherwise, your pitch will be held until dusk on your
day of arrival, after which it will be put up for re-sale.
Pitches must be vacated by midday on the day of departure
unless otherwise agreed with the Site Manager. For departures
after midday, there will be a charge of £3 per pitch and is subject
to availability.
On all our sites, the
maximum stay allowed is 28 days, after which time your pitch must
be vacated for at least 3 days before return to the pitch.
You may only extend your stay up to a maximum of two 28 day
periods within one year. All 28 day stays will qualify
for a discount of 10% on the standard pitch fee in low and mid
season.
13. Minimum
Age
We can only accept bookings for parties where
there is at least one person aged 18 years or over.
14.
Complaints
We are most concerned that you have an
enjoyable holiday. Should you nevertheless have cause for
complaint, please contact our Site Manager immediately who will
advise you of our complaints procedure.
15. Promotions and
Special Offers
Promotions or discounted offers are
provided at the discretion of Forest Holidays. All offers are
subject to availability, cannot be used in conjunction with any
other offer or discounted may be withdrawn at any time.
Retrospective refunds are not permitted against any offer or
promotion advertised after such time a booking is made.
16. Third
Parties
Reference to any products, services
processes, trade names, trademarks or other information of third
parties does not imply or constitute an endorsement, sponsorship or
recommendation by Forest Holidays. Links to other services
not operated by Forest Holidays are solely for your convenience.
Forest Holidays is not responsible for any products,
services, processes, trade names, trademarks or other information
provided by third parties.
17.
Behaviour
The booker is responsible for the behaviour
of all members of the party. Please respect other users of the
campsite and their property. Please keep noise levels to a
minimum after 10:30pm. Any willful damage to the site or
other Forest Holidays property will result in the party being asked
to leave the site. No compensation is available for any
forfeited nights.
18. Force
Majeure
Forest Holidays cannot accept responsibility
for any holiday where it is affected or prevented by reason of
circumstances that amount to force majeure. 'Force Majeure'
means any event that Forest Holidays or any associated supplier
could not, even with due care, have foreseen or avoided. Such
circumstances include war, threat of war, civil strife, industrial
action, terrorist activity, natural or nuclear disaster, fire,
adverse weather conditions, foot and mouth disease and all other
similar events outside of our control.
19. Privacy
Policy
Forest Holidays respects your right to
privacy. In the statement to follow you will find full
details of how Forest Holidays protects and secures your personal
information.
How do we use your
data?
Forest Holidays will use the
information you provide to us in order to:
• process your new Forest
Holidays Card applications and renewals submitted to us
• verify financial
transactions
• investigate and resolve
any problems with any services supplied to you
• improve the content of our
web pages
• carry out research on our
visitors in order to improve the service offered to you
• contact you with any
questions or queries relating to your booking
We may also occasionally
wish to use this data to send you information which may be of
interest to you. Any correspondence you receive will also
give you the opportunity to opt-out at any point if you would
prefer not to continue receiving information.
Do Forest Holidays
share personal details?
Subject to Condition 19
below, no, Forest Holidays has a policy to not provide your
personal data to any third parties other than dedicated customer
service providers.

20. Sharing
Information
Information is shared with a) our bank
and b) our partners and c) involved third parties, e.g. Insurance,
credit cards etc. When paying by credit or debit card we pass
your card details to our bank for authorisation of the transaction
and for payment. We do not disclose your details to any other
person without your consent unless there is an emergency situation
that requires it or we are legally required to do so.
21.
Disclosure
By agreeing to these terms and conditions you are agreeing to abide
by all of our site policies which are available at all of our
sites.
22.
Liability
Unless required by law, we will not be
liable to you for any loss of profit, loss of business or loss of
goodwill or for any indirect or consequential losses whatsoever and
our maximum liability shall be no more than to refund the amount
paid by you for the holiday.
We shall have no liability
to you for any failure to perform any of our obligations under the
contract if and to the extent that the failure is caused by act of
God, governmental restriction, condition or control or by reason of
any act done or not done pursuant to trade dispute, shortages of
labour or materials or breakdown of machinery or any other matter
(whether or not similar to the foregoing) outside of our
control.
Notwithstanding the
foregoing, nothing in these terms and conditions is intended to
limit any right you may have as a consumer under local law or other
statutory rights that may not be excluded nor in any way to exclude
or limit our liability to you for any death or personal injury
resulting from our negligence.
23. Third Party
Rights
No person (except you and us) shall have any
rights pursuant to the Contract (Rights of Third Parties) Act 1999
(the “Act”) to enforce any of these terms and conditions. Any
right or remedy of a third party which exists or is available apart
from the Act is not affected.
24. Governing
Law
These terms and conditions shall be governed and
interpreted exclusively according to the laws of England or
Scotland, depending which is appropriate. We and you agree to
submit to the exclusive jurisdiction of the English or
Scottish Courts in relation to any matters of dispute arising
out of or in connection with these conditions provided that we may,
at our option, take proceedings in the courts of the state or
country in which you are domiciled including action to obtain any
remedy (including injunctive relief).
The contract between us
shall be concluded in the English language.

Forest
Holidays uses pixels, or transparent GIF files, to help manage
online advertising. These GIF files are provided by our ad
management partner, DoubleClick. These files enable
DoubleClick to recognize a unique cookie on your Web browser, which
in turn enables us to learn which advertisements bring users to our
website. The cookie was placed by us, or by another
advertiser who works with DoubleClick. With both cookies and
Spotlight technology, the information that we collect and share is
anonymous and not personally identifiable. It does not
contain your name, address, telephone number, or email address.
