Breakage and Cancellation Cover

Cancellation cover costs £7.50 for short breaks and £15 for week stays and provides protection as soon as your booking is confirmed and ends when the person taking out the cover leaves home to commence the holiday.   Breakage cover costs £6 and provides protection as soon as you arrive on site and ends when the person taking out the cover leaves the cabin.

If Breakage cover is not taken a £50 breakages deposit will be payable on arrival at the site.

• Cover for accidental breakage of furniture, appliances and utensils when kept within the cabin

• Cover for accidental damage to structural features of the building.

If notification of breakage is received prior to check out, you will not be liable for the cost of repair.

Significant Exclusions

This scheme does not cover:

• Wilful breakage of furniture, appliances and utensils when kept within the cabin

• Wilful damage to structural features of the building.

Cancellation

You may cancel the scheme without charge within 14 days of purchase provided you have not used the scheme or made a claim. If you do not cancel the scheme within 14 days, you will be liable for the full Price.

Claims Provisions

Notification of breakage must be received prior to check out and details must be given direct to the Site Manager.

Duration

The scheme provides cover for:

• Cancellation protection as soon as your booking is confirmed (the price you paid for this scheme will be added to your holiday booking price (the “Price”)) and ends when the person taking out the cover leaves home to commence the holiday.

• Curtailment protection from the time you leave home until you return at the end of the holiday, up to a maximum of 31 days.

Significant Features & Benefits

The scheme will provide the following benefits if, after your booking is accepted, it is necessary and unavoidable for:

1. the party to cancel or curtail the holiday due to a Qualifying Reason (as below):

i) If cancellation notification is received prior to balance payment (12 weeks prior to departure), we will refund your deposit payment, less the Price paid for cover and £20 administration fee

ii) If cancellation notification is received after balance payment, we will refund all monies paid less the Price paid for cover and £20 administration fee.

iii) If the party curtails the holiday and returns home we will give you a proportionate refund of the cost of the holiday less the Price for this scheme.  In the case of multiple or party bookings where more than one cabin is booked at the same time, cover is assessed on each cabin individually.

Qualifying Reasons

Death, bodily injury, illness or admission to hospital as an in-patient of you or any other member of the party, a partner or member of the immediate family.

Compulsory quarantine of a member of the party or their travel being prevented by Government restriction following an epidemic. Redundancy qualifying for payment under any applicable statute which is notified to and received by you after your booking is accepted. Unforeseen occupational international posting in a covered person’s present employment; or withdrawal of annual leave because of an unforeseen business emergency of a member of the party. Hi-jack. A member of the party being required for compulsory jury or witness service in a Court of Law in proceedings to be undertaken during the time of the booking. Police requiring

a member of their party to attend following theft at their home or usual place of business; or damage rendering a member of the party’s home uninhabitable.

Significant Exclusions

A member of the party deciding not to travel or, if on a holiday, deciding not to continue; war and similar risks; changes in a member of the party’s financial circumstances or unemployment other than redundancy

Cancellation

You may cancel the scheme within 14 days of purchase provided you have not taken your holiday, used the scheme or made a claim. If you do not cancel the scheme within 14 days, you will be liable for the full Price.

Claims Provisions

To make a claim please contact Forest Holidays LLP, Bath Yard, Moira, Derbyshire, DE12 6BD immediately the circumstances leading to the cancellation or curtailment arise, then confirm in writing, supplying documentary evidence, including medical certificates where appropriate, to support your claim. Note that all persons in your entire party must cancel or curtail the holiday and the accommodation must be left vacant in order to benefit from a claim under this scheme. If you need to curtail the holiday you must advise the site manager before returning home

Terms and Conditions

Forest Holidays LLP (referred to as Forest Holidays/we/our/us) makes sales of cabin holidays via www.forestholidays.co.uk (the “Website”) , via its call centre, via email requests and takes bookings direct at the cabin sites. Any person wishing to book a holiday via any of these methods (referred to as “you/your”) acknowledges that such a booking is made subject to our terms and conditions set out below.

You may only request a booking if you agree to these terms and conditions.

By requesting a booking you are deemed to have accepted these terms and conditions as governing your booking.

This does not affect your statutory rights as a consumer.

We reserve the right to change these terms and conditions at any time. Any such changes will take effect immediately when posted on the Website, in the brochure, at the cabin sites, or otherwise brought to your attention. It is your responsibility to read the terms and conditions each time you request a booking and any such request shall signify you have accepted to be bound by the latest set of terms and conditions.

1. Booking Confirmation

When you wish to place a booking for a holiday (“Booking Request”) with us, you will complete a booking form (either on the website, over the phone, by email, or at the cabin site). It is your responsibility to provide us with the correct information. If you have made the Booking Request via telephone, we will read back your details to you. You will be responsible for the Booking regarding any input errors. If you have made the Booking Request via the Website we shall send an automated response email to you as an order acknowledgement of the Booking Request with a booking reference number.

For all other Booking Requests we process, we shall issue written confirmation accepting your Booking Request with a booking reference number.

Once Forest Holidays has issued such written or email confirmation it shall have entered into a contract with you.

By making a Booking Request you warrant that you have the authority of all persons in your party to book on their behalf, accept these terms and conditions and that you will indemnify Forest Holidays and keep Forest Holidays fully and effectively indemnified against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you.

Bookings are not transferable.

In addition to these terms and conditions, there may be specific rules and regulations which apply to individual sites. These will, where applicable, be prominently displayed in the reception area of each site.

2. Services, Features and Facilities

Apart from your holiday accommodation and access to permitted areas of the forest, none of the features, facilities or services referred to in the brochure or the Website (e.g. bike hire, pony trekking and boat hire) are provided by Forest Holidays or its agents (unless otherwise stated). Forest Holidays shall not have any responsibility for loss, damage or injury in relation to these features, facilities and services which we do not provide.

Information about features, facilities and services for your cabin holiday, is, to the best of our knowledge and belief, accurate at the time of publication of the brochure and Website, All facilities and services are subject to availability.

Diagrams on our Website are intended to illustrate the level and type of accommodation which is available. While these are substantially accurate, there may be some variations in individual cases.

As our cabins are located in a forest environment, we cannot accept responsibility for any damage, injury or inconvenience caused by wildlife.

3. Management

Empowerment for all aspects of site operational management lies with the Site Managers. Forest Holidays fully supports its Site

Managers in dealing with matters of policy at their sole discretion when the need arises. In placing a Booking Request you agree that you and your party will at all times comply with any policies or rules specific to the cabin site or any reasonable instructions or requests of the Site Managers.

4. Payment

If you place your booking more than 12 weeks prior to the start date of your holiday, we will request a deposit of £100 per cabin per week plus any cancellation and breakage cover if taken out The balance of the full payment will be due 12 weeks prior to the start date of your holiday. For all bookings received within 12 weeks of your holiday start date, full payment is due at the time of booking. Non-receipt of the full accommodation charge by the due date will be treated by us as a cancellation of the booking and you will forfeit the total cost of any payments made to date. The booking will then be subject to the cancellation procedure outlined in Condition 5.

5. Cancellation

If you want to cancel your booking you must notify us as soon as possible and confirm in writing. Provided the cancellation is received not less than 12 weeks before the start date of the holiday, only the deposit will be forfeited. If we receive less than 12 weeks’ notice, you will be liable to pay the total cost of the holiday.

To avoid these charges we advise customers to take out our cancellation cover.

Our customers visit our sites to enjoy the peace and tranquillity of the forest. If anyone does not respect this, the Site Manager reserves the right to refuse them admission or ask them to leave the site at any time. If you are asked to leave under these circumstances, no monies will be refunded.

6. Amendments

If you want to amend your booking you must notify us as soon as possible. Amendments to your booking can be made up to 12 weeks prior to the start date of your holiday and are subject to availability and to a £20 administration fee. All amendments are subject to availability. Should you wish to transfer your booking to another location and/or date, we will use our reasonable endeavours to satisfy your request wherever possible, but shall be under no obligation to do so.

7. Pricing

Cabin pricing is calculated across date ranges. If your holiday falls within two (or more) price bands, the corresponding price for each date range will be charged. Prices include VAT at the current prevailing rate where applicable. Whilst we will make every effort to ensure that our prices remain unchanged, they may be amended at any time prior to payment of the final balance. In such circumstances, you may cancel your booking by giving notice in writing, by Recorded Delivery, within 14 days of the issue date printed on your invoice, and we will refund all monies paid in respect of the booking.

Please note the prices advertised in the brochure and on our website are applicable up to and including January 8 2009 only.

8. Occupants

The maximum number of people occupying your accommodation must not exceed the number shown in the particulars of the cabin.

This does not include infants under the age of 2.

Single sex groups and group bookings are welcome at the discretion of the site manager. Please make us aware if you are an all male or an all female group before booking. It is essential that you and your party will at all times comply with any policies or rules specific to the cabin site or any reasonable instructions or requests of the Site Managers.

9. Pets

Some well trained pets are welcome, subject to payment of the appropriate supplement. They must be kept under proper control and must not be left on their own in the cabin. All traces of their presence must be removed before you leave. Please do not allow dogs to sit on the beds or the furniture.

10. Arrival and Departure

Arrival time on site is between 4pm and 8pm on the agreed date of arrival. If you are likely to arrive late, please let the Site Manager know. Please note that arrival may be accommodated from 12 noon (subject to availability and a £15 early arrivals’ fee). Please contact the site directly 7 days before your arrival date if you wish to organise an early arrival.

Your booking ends at 10 am on your agreed date of departure.

A late departure (up to 2pm) may be arranged (subject to availability and a £15 late departure fee).

11. Your Responsibility

The accommodation must be left in a clean and tidy condition. Please make our Site Manager aware of any breakages or damage caused during your stay. Forest Holidays shall be entitled to charge you for any costs or expenses it incurs as a result of any breakage or damage or a failure by you to leave the accommodation in a clean and tidy condition.

12. Cancellation and breakage cover

We advise customers to take out cancellation and breakage cover. Seethe relevant Terms and Conditions on page 22.

13. Mobility Difficulties

We have cabins specially adapted for use by our customers with mobility difficulties. Please make enquiries as to their suitability before booking.

14. Special Requirements

If you have a preference for a particular cabin or location on-site, please let us know at the time of booking. We will, wherever possible, try to meet your requirements subject to availability and a small fee of £10 However, we cannot guarantee this, and cannot accept a booking on this basis.

15. Complaints

We are most concerned that you have an enjoyable holiday.

Should you nevertheless have cause for complaint, please contact our Site Manager immediately who will advise you of our complaints procedure.

16. Promotions and Special Offers

Promotions or discounted offers are provided from time to time at the discretion of Forest Holidays. All offers are subject to availability and may be withdrawn at any time. Retrospective refunds are not permitted against any offer or promotion advertised after such time a booking is made.

17. Third Parties

Forest Holidays is not responsible for any products, services, processes, trade names, trademarks or other information of third parties and reference to does not imply or constitute an endorsement, sponsorship or recommendation by Forest Holidays.

18. Force Majeure

Forest Holidays cannot accept responsibility for any holiday where it is affected or prevented by reason of circumstances that amount to force majeure. ‘Force Majeure’ means any event which Forest Holidays or any associated supplier could not, even with all due care, have foreseen or avoided. Such circumstances include war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, foot and mouth disease and all other similar events outside of our control.

19. Privacy Policy

Forest Holidays respects your right to privacy. In the statement to follow you will find full details of how Forest Holidays protects and secures your personal information.

What data do we collect?

During the booking process of your holiday we are required to ask for personal information which is necessary to allow us to service you requirements. This information may include name, address, email address, telephone and car registration number, country of residence and your age.

How do we use your data?

Forest Holidays will use the information you provide to us in order to:

• process your bookings and any additional services requested through us

• verify financial transactions

• investigate and resolve any problems with any services supplied to you

• we may also occasionally wish to use this data to send you information and offers which may be of interest to you. Should you not wish to receive such offers, please write to us at the above address

Do Forest Holidays share personal details?

Subject to Condition 20 below, no, Forest Holidays has a policy not to provide your personal data to any third parties other than dedicated customer service providers.

20. Sharing Information

Information is shared with a) our bank b) our partners c) involved third parties, e.g. Insurance, credit cards etc. When paying by credit or debit card we pass your card details to our bank for authorisation of the transaction and for payment. We do not disclose your details to any other person without your consent unless there is an emergency situation that requires it or we are legally required to do so.

21. Disclosure

By agreeing to these terms and conditions you are agreeing to abide by all of our site policies which are available at all of our sites.

22. Liability

Unless required by law, we will not be liable to you for any loss of profit, loss of business or loss of goodwill or for any indirect or consequential losses whatsoever and our maximum liability shall be no more than to refund the amount paid by you for the holiday.

We shall have no liability to you for any failure to perform any of our obligations under the contract if and to the extent that the failure is caused by act of God, governmental restriction, condition or control or by reason of any act done or not done pursuant to trade dispute, shortages of labour or materials or breakdown of machinery or any other matter (whether or not similar to the foregoing) outside of our control.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any right you may have as a consumer under local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

23. Third Party Rights

No person (except you and us) shall have any rights pursuant to the Contract (Rights of Third Parties) Act 1999 (the “Act”) to enforce any of these terms and conditions. Any right or remedy of a third party which exists or is available apart from the Act is not affected.

24. Governing Law

These terms and conditions shall be governed and interpreted exclusively according to the laws of England. We and you agree to submit to the exclusive jurisdiction of the English Courts in relation to any matters of dispute arising out of or in connection with these conditions provided that we may, at our option, take proceedings in the courts of the state or country in which you are domiciled including action to obtain any remedy (including injunctive relief).

The contract between us shall be concluded in the English language
